General conditions of sale
The Apanage company offers a selection of clothing through its website. The photographs representing the items offered for sale are as faithful as possible but cannot ensure perfect similarity with the product for sale. The photographs therefore have no contractual value. These items may contain imperfections (mentioned in the remarks of the product sheet).
The apanage-vintage.com website is the property of the Apanage company in its entirety, as well as all rights relating thereto. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners.
1. PARTIES
These conditions of sale are concluded on the one hand between the company Apanage registered in the business directory under number: 82028711800039 RCS Nanterre (hereinafter referred to as Apanage ) and on the other hand, any natural or legal person wishing to make a purchase via the website " " (hereinafter referred to as "the customer").
2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The customer acknowledges having read these general terms and conditions of sale at the time of placing the order.
By confirming his purchase through the apanage-vintage.com website, the customer has expressly accepted these general conditions of sale without reservation.
These general terms and conditions of sale govern the contractual relations between Apanage and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other conditions appearing in any other document, unless otherwise agreed in writing.
The general terms and conditions of sale may be modified by Apanage at any time. In the event of modification, the general terms and conditions of sale that are applicable to the order are those that were online and that the customer accepted on the day the order was placed.

These products are offered while stocks last and Apanage is in no way responsible in the event of stock exhaustion.
Our product catalog may change constantly. Each product is accompanied by a description that is as precise as possible.
The photographs, the exclusive property of Apanage , are as faithful as possible but cannot ensure perfect similarity with the product offered for sale, in particular with the colors and materials. The photographs are used for illustrative purposes only within the limits of the technique and the best market standards. The photographs have no contractual value. If errors have been introduced, under no circumstances can Apanage be held liable.
The products offered for sale are not new and have already been used in most situations. Consequently, it is normal that they have traces of wear, scratches, chips or other defects due to their age.
4. ORDER TERMS
All orders are made via the website apanage-vintage.com . Confirmation of the order implies acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions. All data provided and the recorded confirmation will constitute proof of the nature, content and date of the transaction. Confirmation will constitute signature and acceptance of the operations carried out. The sale will only be definitively concluded upon payment of the order.
Apanage will only be committed to executing the order after acceptance of the customer's order, confirmed by an email sent to the address that the customer has communicated to us, and by receipt of a full payment corresponding to the sale price. Apanage reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
In the event of an error in the wording of the recipient's contact details, Apanage cannot be held responsible for any inability to deliver the product.
The sale of products presented on the website is reserved for buyers who reside in France and abroad, provided that deliveries can be made in the country of the customer.
5. PAYMENT TERMS
The customer can pay either via their Paypal account or by credit card via Stripe.
The customer's credit card number is directed to the Paypal and Stripe servers and is never known to Apanage. The order validated by the customer will only be considered effective when the relevant bank payment center has given its approval. In the event of refusal by said center, the order will be automatically canceled and the customer will be notified by email.
All orders are effective upon receipt and collection of payment.
Apanage will issue an invoice upon request.

7. QUALITY AND CONFORMITY ISSUE
In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the customer must make a complaint within 48 hours from the date of receipt of the package. Complaints must be sent by email to hello@apanage-vintage.com
Complaints must include: the buyer's contact details, product references, proof of payment, reasons for the complaint and all supporting documents. The return of the products must be made within seven working days. Failing this, Apanage will not proceed with any exchange or refund of the products thus ordered. Any product to be exchanged or refunded must be returned to Apanage as it was shipped, in its original condition and packaging and include all of the product and its accessories.
Shipping costs are the responsibility of Apanage , except in the case where the returned or exchanged product does not correspond to the original declaration made by the buyer in the return form. The assumption of these return costs will be capped at the rate corresponding to the shipment by Colissimo. Any risk related to the return of the product is the responsibility of the buyer. In the event of non-compliance with the procedure set out above and the deadlines involved, the buyer will not be able to make any claim for non-conformity or apparent defect of the products delivered, the products then being deemed compliant and free from any apparent defect.
8. AVAILABILITY OF PRODUCTS
The products presented on the website are offered within the limits of available stocks. In the event of unavailability of the product ordered , Apanage will inform the buyer as soon as possible.
The buyer will be reimbursed without delay and at the latest within 15 days of payment of the sums he has paid.
9. RIGHT OF WITHDRAWAL
In accordance with Article L 121-16 of the Consumer Code, the customer has a period of 14 days from the date of receipt of the items to return, at their own expense, the products ordered for reimbursement. The products must be returned in perfect condition for resale, in their original condition (packaging, accessories, instructions for use and documentation), duly sealed and accompanied by the invoice corresponding to the purchase. Any incomplete, damaged, damaged product or whose original packaging has been damaged, will not be refunded or exchanged. The customer is advised to use a carrier offering tracking and insurance for the returned goods. In the event that the goods are lost or damaged in transport, Apanage will not be able to reimburse the buyer who will have to make a claim directly to the carrier. In the event of exercising the right of withdrawal, only the price of the product(s) purchased will be refunded. The shipping and return costs are the responsibility of the buyer;
10. PRICE OF PRODUCTS
Prices are given for information purposes only. They are subject to change at any time, depending on market developments and product availability. The prices displayed online are guaranteed, unless, in particular due to an error or technical problem, the price is abnormally low.
The price is expressed in euros on the website per unit in euros, all taxes included, VAT not applicable under article 293 B of the CGI, and corresponds to the rate in effect on the day of the order. The price applicable to the order is the price indicated on the product sheets, on the day of confirmation of the order.
The price does not include shipping costs, which are charged in addition to the price of the products purchased according to the amount of the order. They will be indicated after the order is registered. The price charged to the customer is the price indicated on the order confirmation sent by Apanage . In return, Apanage will provide a delivery quote as soon as possible. The price of the products is payable in cash on the day of the actual order. Payment is made by credit card, PayPal. Furthermore, Apanage reserves the right to refuse any order from a customer.
11. APPLICABLE LAW - DISPUTES
These general conditions of sale are subject to French law.
In the event of a dispute, the customer must first submit a request for amicable settlement before any legal action.
Apanage cannot be held responsible for damages of any kind, whether material, immaterial or physical, which could result from a malfunction or misuse of the products sold. The responsibility of Apanage will, in any case, be limited to the amount of the order and cannot be called into question for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products. Complaints or disputes will always be received with attentive kindness, good faith being always presumed in the one who takes the trouble to explain his situations. In the event of a dispute, the customer will contact Apanage to obtain an amicable solution.
12. WARRANTIES
In any case, Apanage cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country. Apanage 's liability is systematically limited to the value of the product in question, value on its date of sale, and this, without the possibility of recourse against Apanage or the company producing the product.
13. LEGAL INFORMATION
The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders, drawing up invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act, the processing of personal information relating to the customer has been declared to the French National Commission for Information Technology and Civil Liberties (CNIL).
The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise at any time with Apanage . In addition, Apanage undertakes not to communicate, free of charge or with compensation, the contact details of its customers to a third party.
14. RETENTION OF TITLE
Apanage retains full ownership of the products sold until full payment of the price in principal, including costs and taxes. During the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the buyer.
Failure by the customer to fulfil its payment obligations gives Apanage the right to demand the immediate return of the goods delivered at the buyer's expense and risk.
